Welcome to Backbencher (“we,” “us,” “our”). Backbencher provides a platform that connects vehicle owners, professional chauffeurs, and clients seeking premium, chauffeur-driven rides through our website, app, and related services (“the Platform”).

By accessing or using backbencher.app, the Backbencher app, or any of our services, you agree to comply with and be bound by these Terms of Use (“Terms”).

If you do not agree, please do not use our Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Backbencher.

By using our Platform, you confirm that the information you provide is accurate, complete, and up to date.

3. Our Services

Backbencher provides a digital marketplace for:

• Clients to discover and book luxury chauffeur-driven vehicles.
• Vehicle owners to list their cars for approved chauffeur-driven rentals and earning opportunities.
• Backbencher to coordinate professional chauffeurs, manage bookings, and facilitate payments between all parties.

Backbencher acts as a facilitator and technology provider, not a direct vehicle rental company.

Each booking constitutes a contract between the client, the assigned chauffeur, and the vehicle owner.

4. Account Registration

To access certain features, you may be required to create an account.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

You agree to notify Backbencher immediately of any unauthorized access or suspected breach.

5. Vehicle Listings and Bookings

For Clients:

• You may browse available vehicles and make bookings through the Platform.
• All bookings are subject to availability and confirmation.
• Booking details (vehicle type, chauffeur, timing, fees) will be confirmed via email or app notification.

For Vehicle Owners:

• You agree to provide accurate information, documentation, and condition reports for your vehicle.
• Your vehicle must be roadworthy, insured, and compliant with applicable laws.
• Backbencher reserves the right to inspect, verify, or delist any vehicle that does not meet quality, safety, or service standards.

6. Chauffeurs / Drivers

Backbencher works only with verified and approved chauffeurs.

All chauffeurs must meet our screening, licensing, training, and conduct requirements.

Clients and vehicle owners agree to treat chauffeurs with respect and adhere to all service guidelines.

7. Payments and Fees

• All payments are processed securely through Backbencher’s approved payment systems.
• Prices include service and chauffeur fees unless otherwise stated.
• Additional charges (e.g., extra hours, damages, detours, wait time) may apply based on the Booking & Cancellation Policy.
• Backbencher may charge a platform fee for facilitating transactions.

8. Cancellations and Refunds

Client Cancellations:

May incur fees depending on the time of cancellation and type of booking.

Owner/Chauffeur Cancellations:

Repeated or last-minute cancellations may result in penalties, reduced visibility, or suspension.

Backbencher may mediate disputes in good faith but is not responsible for third-party cancellations, no-shows, or service failures beyond our control.

9. User Conduct

You agree not to:

• Misuse, damage, or improperly operate any vehicle.
• Engage in illegal, abusive, or unsafe conduct during a booking.
• Use the Platform for fraudulent activities or unauthorized promotions.
• Attempt to disrupt or compromise the security or performance of Backbencher systems.

Violation of these Terms may result in immediate suspension or permanent termination.

10. Insurance and Liability

• All vehicles listed must carry valid insurance coverage.
• Backbencher facilitates insured chauffeur-driven rides but does not provide primary insurance unless explicitly stated.
• Backbencher is not liable for damages, accidents, delays, losses, or misconduct caused by clients, vehicle owners, chauffeurs, or third parties.

11. Intellectual Property

All trademarks, logos, content, text, images, software, and other materials on Backbencher are the property of Backbencher or its licensors.

You may not copy, reproduce, modify, or distribute any content without written permission.

12. Privacy

Your personal information is handled according to our Privacy Policy, which explains how we collect, process, and safeguard your data.

By using Backbencher, you consent to the practices described in the Privacy Policy.

13. Disclaimers

Backbencher provides the Platform and related services “as is” and “as available”.

We make no guarantee regarding uninterrupted access, availability, or system performance.

Backbencher is not responsible for the actions, omissions, behavior, or performance of clients, owners, or chauffeurs.

14. Limitation of Liability

To the maximum extent permitted by law, Backbencher shall not be liable for:

• Indirect or consequential damages
• Loss of income, revenue, business, or data
• Damages arising from your use or inability to use the Platform

Our total liability is limited to the amount paid to Backbencher for the specific booking in question.

15. Indemnification

You agree to indemnify Backbencher, its directors, partners, staff, and affiliates against any claims or expenses resulting from:

• Your misuse of the Platform
• Your breach of these Terms
• Your violation of applicable laws

16. Modifications

Backbencher may update or modify these Terms at any time.
